Patna: The Patna High Court has verbally observed that state-state medical universities in Bihar may get stopped in the midst of the current situation after learning that at all 2083 of the 31309 assistant posts and professor associates lie in these institutions.
Observations came from the Chakadhari judicial bench Sharan Singh on Tuesday when he heard two petitions submitted by 11 teaching staff at this college.
All 11 of these applicants are the previous faculty with different medical colleges throughout the country.
They were appointed as assistant professors, associate professors or professors in various government medical colleges in Bihar in the last 10-12 years by the high-level health department committee.
Those who were appointed as assistants or professor associates were even promoted and then made a professor.
However, they were then elected through the Bihar Public Service Commission but got a regular encounter promise in the rank of assistant professor even after having a lot of experience to become a professor.
The applicant, represented by Counsel PK Shahi, YV Giri and Shashi Bhushan Kumar, finally moved the High Court in December last year urged that the authorities concerned were directed that their experience was taken into account and was appointed as a professor whose number lied empty.
This is the background of these prayers that the bench asked the state government on July 12 about the details of approved and empty professor assistant posts, professors and professor associates.
The state government submitted additional Affidavit who considered that there were 3309 poles of sanctions from the three ranks of teaching staff in all government medical universities in Bihar lying empty.
After knowing this that the court made oral observations that such situations could cause cessation of recognition of this medical college because it could not meet the basic teaching requirements.
For the rank of assistant professor, there were 1788 programmed posts where 409 worked as a regular appointment, 306 worked on the contract and the remaining 1073 posts were empty.
For the Associate Professor rank, there are 1039 posts that are approved 257 where 257 is filled with a regular appointment, 100 via contract and 682 posts lie empty.
While ranked Professor, there were 91 people appointed regularly, 63 contracts and 328 posts lay empty on a total of 482 approved posts.
The court was also informed that all necessary steps were taken by the Ministry of Health to fill empty posts.
However, the bench was still dissatisfied and instead directed the main secretary to answer that what steps were taken to fill a large number of empty posts in the three ranks along with the actions taken to overcome the applicant’s complaints that had worked in a higher position.
The bench also observed that the division bench from this high court had given a command last year that the empty post was filled by a routine appointment and not by repeating contract promises.
The court will hear this problem again on August 17.
