Gurgaon: Former Gurgaon MLA along with BJP leader Umesh Aggarwal and others are booked for allegedly breaking an illegal colony at Badshapur. Even the ex-MLA and his partners are accused of growing the colony marketed as’Avenue 69′ — more than five acres of agricultural land at town with no consent by the government and selling plots inside. This is actually the next FIR from Aggarwal this season for growing prohibited colonies. An FIR was filed against Aggarwal and his partners Dinesh Bharadwaj, Ved Prakash Ahuja and Raj Kumar Chugh in Sector 65 police station on Friday. Last month, a case was registered following a complaint from the district city planner in Kherki Daula police station against Aggarwal along with others for supposedly breaking an illegal colony in Sector 77’s Shikohpur village. Aggarwal, meanwhile, denied his participation in the offense. “I don’t have anything to do with this. I’m consulting my legal group and intending to proceed dad,” he told TOI. Badshapur village has been advised as a metropolitan place under Section 7A of both Haryana Development and Regulation of Urban Areas Act, 1975. According to the Act, a property owner requires a license from the manager of the section of city and country planning (DTCP) before creating a colony in notified regions. Further, the Section 1 (I) of this Act prohibits the subdivision of this property for dividing the colony, Section (ii) prohibits building within a colony where license hasn’t yet been given by the section, and Section 1 (iii) prohibits Allergic or re-erecting any construction other than for purposes of agriculture within the property campaigning for agriculture. DTP (authorities ) RS Batth said building activities were underway from the illegal colony even though a note from the division. “The DTCP manager has provided strict instructions to take actions against those who take part with growth of colonies that are illegal, in addition to people who tempt individuals to put money into these prohibited colonies,” Batth stated, adding that the attention of this department will be about executing demolition drives in these colonies in the first phase. The agricultural property where the prohibited colony has been designed belongs to Dinesh Bhardwaj. DTCP had filed a show-cause note on June 14, 2019. The offenders filed their answer to June 21that has been discovered disappointing. They continued with the evolution of the illegal colony in breach of the standards, officials explained. After enrollment of FIR, as necessary under Section 11 of this Act, before placing the challan before the court authorities have to accept sanction for prosecution of these offenders in the Gurgaon deputy commissioner. A police officer, not below the rank of sub-inspector, has got the ability to detain such criminals. DTCP has requested authorities to maintain a vigil in the region and bring any case of unauthorised colonisation into the notice of their section.
