50% Quota: Madras High Court hit away

Chennai: Madras High Court on Tuesday set aside government orders to provide reservations for women above and above 50% stamp in elections to Greater Chennai Corporation.
The first bench from the acting Chair of Munishwar Nath Bhandari and Justice P D Audikesavalu passed order while allowing a request to move by Advocates R Parhiban challenging validity.
The court has now directed the State Election Commission to limit seats to women in urban local agencies to 50% as mandate in law.
According to the applicant, 105 of 200 seats in Chennai Corporation have been allocated to women who are not constitutional and the number of discrimination against men.
Representing the Petitioner, Senior Advocate S Prabakanan believes that in 2016, the city law was found to order 50% of seats on a local agency for women.
Shows anomalies in the order seat above and above 50% in Chennai Corporation, Prabakanan said, “expression ‘no less than 50%’ should not be interpreted to mean that reservations for women can be provided even more than 50%.” Demonstrating the regularity of the government issued in 2019, the Applicant said, 16 corporate seats had been provided for caste schedules, 16 for scheduled caste women and 89 for women in the general category.
“Of the 200 seats, 105 seats have been provided for women both in the SC and general categories.
But in accordance with 50% of orders for women’s policies, only 84 seats should be allocated in the general category.
But violating the norms, more seats have been allocated male discrimination, “He added.
