6 months prison too harsh to drink dried drinks: court

Ahmedabad: Gandhinagar Session The court said that six months of hard prison was too loud to drink liquor and reduce the term prison of a man who was booked twice for boozing, up to 10 and 15 days.
These cases involved one Amit Maheta, 49, from the city of Mansa in the Gandhinagar district.
He was first ordered below Section 66 (1) (B) and 85 (1) (3) of the Gujarat ban law and with Gujarat police provisions acted to create public interruptions on March 14, 2015.
Three months later, 12 June, the police mana raided his house and arrested him while drunk, and scored it with the same provisions.
The Masterial Court in Mansa conducted a trial and on April 7, 2018 held by Maheta guilty of drinking liquor below Section 66 (1) (b) on both occasions.
The trial court released him from other charges.
In both cases, he was sentenced to six months in prison and a fine of Rs 1,000.
The law determines a maximum of six months in prison and a fine of RS 1,000 when caught drunk for the first time, and for violations of the two sentences can increase up to two years in prison and a fine of up to RS 2,000.
Maheta challenged his belief in the presence of a court session and claimed to be innocent.
The court session enforced court court decision to hold a maheta guilty of violations of the law of ban in both cases.
When he arrived at the quantum of punishment, the court felt a six-month imprisonment was “a long period of time and the defendant had to be placed behind the bar for a fair and reasonable time”.
After observing that a tight prison sentence of six months was too high, the court said that Maheta did not have a criminal anteceden and reduced his prison department to 15 days for the first violation and 10 days for the second.
It is said that the requirements of reduced “reasonable and only to punish the defendant to consume alcohol and at the same time he should not be detained for a long time where he can get the knowledge of serious and vile crime commissions from customs violators”.
