Kanpur: Special Judge, Act Pocso Court, Rajveer Singh on Tuesday Sentenced Accused of being accused of Banwari Lal To18 years in a rigorous prison and slapped the fine of Rs 30.00 to exploit a little girl physically.
The court in the order of observing that if the defendant failed to pay a fine, he had to suffer other prison terms for three months.
Of the good amount, Rs 15000 was given to victims for rehabilitation.
The accused period has been passed in prison so far will be adjusted in the term sentence, the court observes.
According to Onkar Nath Verma, an additional district government advisor (ADGC), the incident has occurred in 2013 when the victim was only ten years old and the defendant was 65 years old.
The incident report was submitted by the victim’s mother on July 27, 2013.
He stated in the report on July 27, 2013 around 8pm suddenly began to rain because most of the residents of the Rakhi Territory took into their homes.
The defendant who used to run a grocery store has arrested and dragged his daughter to a dilapidated building and physically exploited him, alleged complainant.
Hearing his daughter’s scream, he and his neighbor rushed to the place.
When accused of Banwari Lal saw them approaching him, he escaped from the place, he said.
The defendant in his defense stated that because he was a member of the slum development committee, he had been involved in this case.
But when the court checked the documents, it was found that he was not a member of the committee, and he only gave a memorandum to the committee and suggested some work.
In quantum sentences, the defendant begged that because it was his first violation, and had the responsibility to support his family.
When he was 65 years old and had passed a period of more than three years in prison, therefore, the court must take a soft view and give a lower sentence, the defendant begged.
On the other hand, prosecution argues that because of his actions, the future of a small girl has become dark, therefore, he must be awarded severe punishment.
The court, after proof and on the basis of the argument, punished the appropriate defendant.
