Vadodara: The local court in Vadodara on Friday rejected the Ulama guarantee application that had been inter-religious marriage sermon and was also suspected of repenting a woman’s religion.
A case filed in this case is the first-of-type violation that will be registered under the amended actions, which is popularly referred to as the law of ‘love jihad’.
Sheikh Islamuddin’s scholar, who was accused of conversion of religion that violated Gujarat 2021 religious freedom laws (Amendment), has been booked in June together with other charges, Sameer Qureshi.
The accusation was thought to hide his identity to persuade young women who forced him to get married.
After the first pleasure plea was submitted before the cost sheet was filed in this case was rejected, the Ulama filed again earlier this week, after the charging sheet had been submitted.
His advice H Gupta believes that Sheikh only performs rituals and does not have an active role in violations.
The Guarantee application also mentions the recent view of the High Court provides an interim to live in some of the provisions of the action as one of the reasons.
It also mentioned that three were accused of this case, including QureShi’s parents and his sister, had been given a previous guarantee.
Refusing Plea Bail, the Special Judge Court (AtroCity) S C Gandhi observed that it was proven that Sheikh was united with Qureshi.
Furthermore observed that the defendant was involved in placing pressure on the complainant in this case.
This mentions that the defendant has violated the provisions of the actions and rules framed below it because he did not take the permission needed to do rituals.
The court also observed that the guarantee on the basis of parity also could not be considered as a parent and sister of the QureShi role limited to arguing with the victim because he was not wearing Burkha.
It stated that the role of Sheikh was serious in violations.
Gupta, however, argues that the previous complainant has completed the information that supports the defendant.
Affidavit submitted during the viewing of the Qureshi guarantee application.
He added that the complainant and the defendant jointly submitted a petition in the High Court who was seeking dismissal of violations.
However, the public prosecutor (APP) A B Joshi, however, argues that the complainants have issued a notification in connection with the Sheikh guarantee application, but not yet present.
He argued that written statements that conflict with violations may have been submitted under pressure.
This application also highlights that Sheikh is a resident of West Bengal and may not be present during the trial and also he can threaten witnesses and help defendants who have not been arrested.
Women who have registered a violation at the Gotri Police Station, accused Qureshi forced him to be a physical relationship before marriage and told the police that he was forced to undergo an abortion every time he was pregnant.
He alleged that he extorted him to concede his demands using his intimate photos.
He also accused of being harassed by the QureShi family.
Gupta said that scholars will now approach the high court for guarantees.
