Hyderabad: In a setback to Senior IAS officer of AP, Y Srilakshmi, Telangana High Court on Thursday said that the CBI court is free to begin his trial in an alleged illegal mining case involving Obulapuram Mining Company (OMC).
Rejecting the argument that the alleged illegal mining by OMC and its border with Bellari Iron Ore Pvt Ltd (BIOP) diinterpedasi, Justice Shameem Akher reject his petition seeking adjournment until the border dispute resolved and raised first in the CBI court.

Reminding that it is nine years since the case was filed, the judge said, “The legal process can not be abused by the defendant, and trial procedures on land thwart thin.” Chargesheet CBI claimed that Srilakshmi in his previous term as Secretary of Industry and Mining at the AP is not divided along with OMC and mining promoter Baron Gali Janardhan Reddy in granting mining leases in Anantapur.

“Without addressing disputes that the issue will not reach finality on charges of cross-border mining can never be determined without determining limits.
Only when the CBI filed a final report on the border dispute, one can assume that an investigation of this case is over,” said Raghavacharyulu.
“Therefore, the trial court can not proceed without the completion of the CBI probe into the matter,” said counsel Raghavacharyulu.
He also said that the CBI had not filed any memo before the court hearing to menyembunyi border dispute between AP and Karnataka illegal mining case.
CBI for his part said that the probe into the OMC illegal mining case is completed and the court is free to initiate proceedings.
“We’re not going to ask more chargesheet in the court proceedings on this issue,” said CBI Counsel K Surender.
Akther Justice, while rejecting the petition Srilakshmi, said the border dispute has risen to the Supreme Court which ordered the Surveyor General of India to submit a final report.
Reports filed with the SC received by Karnataka, but the AP has expressed certain reservations.
SC has left it to the center to implement this report and restrict the border, said the judge.
