Mumbai: The Bombay High Court on Wednesday rejected the request for anticipatory guarantee by Sam D’Souza, whose name has appeared in connection with the case of Cruise Cordelia medicine.
“Applicants prefer the application without approaching the session court and therefore rejected,” said Justice Surendra Tavade.
He heard the request by Sanville D’Souza, aka Sam D’Souza, who was also urgent for notice three days before the coercion step was taken against him.
D’Souza moved the court capturing arrest by a special investigation team arranged by the state government to see accusations of rewards.
There was a suspicion made by a witness, Prabhakar Sail, that the RS 18 Crore agreement was made to release Arya Khan.
Sail specifically named D’Souza as beneficiaries.
Advocates D’Souza argued that he was not charged as a defendant and had no anxiety against him.
“During the course (sic) the accusation made by several people against Sameer Wankhede stated to provide assistance that he had taken money,” he said.
But Justice Tavade interrupted him, said he would not hear the petition.
“I will not entertain this.
You have a forum.
Don’t waste my time,” he added.
Justice holiday bench s tavade heard d’souza at the end of Wednesday night.
Responding to it, the judge noted that the applicant must first approach the session court.
D’Souza claimed that in the appeal that Kiran Gosavi, witnesses of the Narcotics Control Bureau (NCB) in this case, had taken Rs 50 Lakh from manager Shah Rukh Khan Pooja Dadlani to release Arya.
The amount was returned after NCB arrested a 23-year-old child in case on October 3, the application said.
