New Delhi: The Delhi High Court has given a divorce to a partner with a reasons for mental cruelty by the husband, observing that he looked at his wife as a “cash cow” and became interested in himself only after he got a job with Delhi police.
A bench headed by Vipin Sanghi justice said the materialistic attitude of the husband, without emotional bond, would cause mental and traumatic suffering to his wife, which was sufficient to form his cruelty.
The bench also consists of Jasmeet Singh justice, observing that in general, it is the desire of every married woman to start a family, however, in this case, husband seems “not interested in maintaining marriage but only interested in wife’s income”.
The court set aside the commandment of a family court that rejected the divorce petition and dissolved marriage between the parties under Hindu marriage law.
He is looking for divorce on the ground that husbands unemployed, an alcoholic and used to physically abuse and demand money.
In this case, the two parties belonged to a bad background and marriage were stated by everyone and wife of 19 years and 13 years old.
Even after reaching the age of majority in 2005, the wife was not taken to the matrimonial house until November 2014, namely, when she secured a job with Delhi police.
“The sustainable distance between the parties even after the Petitioner (wife) reaches the majority will, by itself, has caused trauma and lead to atrocities to the Petitioner besides all others …
(The) stated the Applicant’s attitude, the respondent (husband) harassed the applicant for Pocketing his income, because he himself is unemployed, “said the court.
“Respondents, appeared, looked at the applicant as a cash cow and became interested in him only after he got a job with Delhi police.
The attitude of respondents who compounded angrily, without emotional bonds, would by itself cause mental and traumatic suffering for the applicant enough to form his atrocities, “He added.
