Ahmedabad: Special Pocso Court in Mirzapur ordered the release of a young man who was arrested on charges of rape after he argued that his detention would extend the victim’s trial because he was his wife now.
The victim also reaffirmed the same dispute in a written statement and requested his direct release of the man.
This case involved Amreli Resident Nareshbhai Chudasama, who was in the early 20s.
He had married a 15-year-old girl in 2018.
Chudasama was first ordered under the protection of children from sexual violations (Pocso) acting with the Vadhvan police station in Surdendranagar.
When the police traced the couple, the girl refused to go with her father and sent to a woman’s shelter in Rajkot.
The couple managed to unite once again and escaped from the place.
The girl’s father filed another complaint with the Dholera police in the Ahmedabad district under the allegations of Pocso and IPC.
Nearly three years later, Chudasama was arrested by the Dholera police and sent to the trial.
After the police submitted a Chargesheet against him, Chudasama filed a regular guarantee and was heard by the Pocso Judge specifically at the Rural Mirzapur Court.
He claimed innocently and surrendered that when the girl was 18 years old, they got their marriage registered in the sub-registrar on June 14, 2021.
His advocate argued further, “after the marriage, the couple began living together as a husband and wife.
If the Defendant Continuing to be imprisoned, the victim in this case would only suffer because he lived in the defendant’s house as his wife.
“The prosecution and father of the victim were hard against Plea Guarantee.
However, the victim submitted a written statement and pleaded for a direct release accused.
He stated that they had fallen in love for a long time and he wanted to marry him.
“When he becomes an adult, they tie the node and get their marriage registered.
He now lives at the defendant’s house with his family.
If her husband is made in a long prison, he must face difficulties,” he said in the statement.
After hearing this case, the Special Judge T K Rana guarantees Chudasama about various conditions such as he regularly attended the court process and would not try to influence the witness.
