Nagpur: Appearing to rescue the Anoop Kumre prison supervisor, the Supreme Court has directed that the bad comments recorded by the Nagpur bench from the Bombay High Court against him in the process of insulting Suo Motu will be abolished from his service book.
HC has been on February 26, 2021, directs the excavation (prison) to enter the order in the Kumre service book.
The first was told to obey his direction within 15 days and submit a written statement along with a photocopy of the service book that said the HC command against Kumre.
The division bench consisting of Judge Sunil Shukre and Avinash Gharote has directed the HC registry to register the insult to Suo Motu against Kumre after he failed to explain the reason not to release the defendant Ravishekhar Londekar from prison, even though there was an order.
HC order was challenged by the applicant through the advice of Sudhir Voditel in the APEX court, which competed that Londekar was released a day after the order.
He has even submitted an unconditional apology received by the HC bench, still orders are given to enter the service book.
Voditel believes that it will harm the interests of the future of Kumre.
“Paying attention to the submission made and the material on the note, we find a substance that once the unconditional apology made by the applicant is taken on the note, and the process of standing down, there seems to be no reason or justification to continue the direction further to enter the book.
More than that, when he has maintained a non-blocked service record as placed before us for perusal, “said the division bench consisting of Adil Ajay Rastogi and Abhay Oka.
After the CBI arrested Londekar, his relatives knocked on HC’s door for his release.
HC ordered the release of the defendant to the guarantee to complete the RS50,000 PR Bond and one solvent guarantor of RS20,000.
However, Kumre and other prison officials did not let him quote the Prison manual rules that no detention could be released after 5 pm.
They also told his relatives to bring session court orders in this case.
