Nagpur: The Imambada police were not interested in registering a violation to violate Covid’s restrictions on the owner of Jack’s Bar-pub agent in the Trillium Mall on Saturday, until senior police officers intervened.
The police have avoided registering violations, even after the detection squad of the Dhantoli Zone Disorders NMC (NDS) slapped the fine of RS30,000 on pub management for violations of Covid restrictions.
The video place shows a place full of customers, including many without masks, and also does not maintain social distance.
The NMC team has also confirmed violations in their findings.
Although the state government has taken actions of epidemic diseases and disaster management laws, and CP Amitesh Kumar has imposed part 144 CRPC, Imambada police are not sure about registering violations, quoting NMC actions as sufficient.
CP Amitesh Kumar said the police were in two thoughts as a registration of violations of the pub owner after the NMC action would be the same as ‘double jeopardy’ (taking actions twice for the same violation).
“I have instructed Zonal DCP to follow up on the current action with sealing procedures,” he said.
The case was registered at the Imambada Police Station at 10:50 PM against the owner of Pawan Nirban PUB because of the violation of Norma Covid.
Previously at night, police NMC and Imambada together invaded the place at 9.20p, but the police were waiting to start the action until senior officials pushed them.
Legal expert Shrerang Bhandarkar said the NMC penalty was for violations of Covid norms and SOPs, which NMC had applied to these places (pubs and others).
This action by local civilian authorities can be categorized as ‘civil obligations’.
“Police actions are enforcement of criminal liability, which are different from civil obligations.
There are no questions about double jeopardy,” said Bhandandar.
In the past, Zonal DCP Vinita, during the attack along with the NDS team, has ensured a sealed location and violations registered in a number of pub owners, restaurants, hotels, hookah homes, and outlets like that in Western Nagpur for Covid’s violations.
Even Zonal DCP Neelotpal has raided the Kadiwala Pankaj shop in Jaripatka, a registered violation and also ensured the place was sealed by the NDS in simultaneous actions for violations of restrictions Covid.
