Ahmedabad: The Gujarat High Court on Tuesday gave a conditional guarantee to the leader of the Movement of Pattalgadi, Babita Kachhap, who was arrested by Gujarat ATS from Vyara on charges of incitement and conspiraced to fight against the nation.
While ordering the release of tribal rights activists, HC noted that he raised the voice by interpreting the constitution in his own attitude showing not showing how he committed a violation of incitement or conspiring for the Wagea War against the nation.
In addition, there was no disruption recorded in Gujarat because of his movements, especially as long as he lived here.
Kachhap was arrested in July 2020 which was allegedly to incite followers of SATI-PATI Tribal SULT in Gujarat to take ways of violence with the wrong interpretation of the fifth constitutional schedule and fight against India against India.
The police claimed that Kachhap’s colleagues and joint accusations in cases that nested against him at Jharkhand had made people fight based on caste and class.
The police also claimed that documents and cellphones seized from him contained burdensome material.
After hearing the advocate of Kachhap Zubin Bharda and a Zabuaawala, justice S H Vora gave him a guarantee of furniture bonds of rs 20,000 with one guarantee with the same amount.
The court observed that during Kachhap lived in Gujarat, there was no violence or violation of peace which actually happened at any time.
Fir they are registered only based on cases that are nested in Jharkhand.
The High Court noticed that the literature seized from it is available on the internet and the government can show incriminating material that can cause prayer section 121a and 124a IPC.
