New Delhi: Indicates that it was a policy decision, Delhi High Court on Tuesday refused to comfort the petition that challenged the steps to allow 100% seating in Metro Delhi and Plying buses in the national capital.
“This is a policy decision, why should we interfere? Do not use it if you do not like it,” Sanghi Vipin Judges and Jasmet Singh commented, adding it was for the authorities to accept public transport regulations.
The court said if every user of public transport or citizens was allowed to increase such problems and challenge the government’s decision, there would be no end of such petitions.
The court said there was no service in the challenging petition of July 24 from the Delhi Disaster Management Authority (DDMA), the Delhi government, which allowed a 100% seat capacity in Delhi Metro, DTC and Bus Cluster.
“Today this applicant suggests that the Metro / Bus must run with a capacity of 50%, tomorrow other people will say this is not too much, make 30 or 20%.
It cannot be permitted, doing the authority running like that?” The court wondered.
It rejected the request submitted by one B Tripathi, who said he used public transportation and claimed the government’s decision to violate his fundamental rights to life because the capacity of high seating in Delhi Metro and the bus would expose the danger of the Covid-19 contract.
The applicant said the same order of DDMA allowed the bar and restaurant to function with 50% seating capacity and the decision to allow 100% seating capacity in public transportation was irrational.
However, the court, noted that the idea behind a capacity of 50% in the bar and restaurant was that people who went there were allowed to consume food, which did not occur in the Metro and the bus where passengers had to keep their masks all the time.
To avoid density, the authorities did not allow passengers to travel while standing, he said.
“It is a competent authority assigned by administrative responsibility to take information on information about matters about public transport regulations and open and run markets, restaurants, bars and cinema rooms,” Bench said.
