Bengaluru: Violations below Section 3 Law Part 3 SC / SC (Prevention of Atrocities) cannot be called in the ChargesHet sheet only because the alleged victim of the crime is included in the scheduled caste or the scheduled tribe, the Karnataka High Court has said in terms of new ordering .
“It’s not as if in every crime, if the victim happens to be a member of SC or ST, a violation below part 3 of the law has been carried out.
If the motive for crime is not the person, the defendant can only be admired for one of the violations under the punishment code India, “Judge Sreenivas Harish Kumar had observed his orders.
This action is intended to protect the SCS or STS from atrocities or oppression, the judge said, and cannot be allowed to be misused.
“Therefore, there is a greater responsibility for investigative officers to make decisions wisely before submitting a chargesheet,” said the order while canceling the process that began against an applicant before the city’s special court.
In this case, the judge noted that there was no violation of the atrocities that appeared to have occurred.
Violations are under the IPC section related to call avoidance.
