New Delhi: The Delhi High Court has rejected the petition submitted by Personel 30 Indo Tibet Border Police (ITBP) for transfer in Afghanistan which was hit by violence, said it was “amazing us” that anyone would be interested in returning there despite the “dangerous situation”.
“Applicants, as a personnel of armed forces such as ITBP, can be posted anywhere based on the requirements …
(but) they do not have the right to be deployed in Afghanistan,” said Bench of Judge Sahai Endlaw and Amit Bansal.
The applicant has been deployed in Kandahar before being withdrawn.
ITBP has a unit placed in Afghanistan to maintain the Indian Embassy in Kabul and also the Consulate General in Kandahar.
The source said the ITBP Posse reported to the Ministry of External Affairs to serve abroad and chosen personnel received generous extra allowances and other benefits, making it a risky but profitable task.
After the latest interference in Afghanistan, India decided for a while approaching its consulate in Kandahar.
HC shows that “the situation in Afghanistan is a liquid, and urgent decisions must be taken in connection with the operation of the Indian mission there along with ensuring personnel safety”.
Appearing for the Director General of ITBP, the income advisor of the Gaza Kanturkan Central Government argued that the deployment of personnel on foreign missions, de-induction and reproduction was a pure administration problem.
The bench agreed to the argument, noting that “the court cannot determine where and how ITBP personnel must be posted”.
