Chennai: Holding the Green Tribunal National Bursts (NGT) in Delhi and various regions standing with the same footing, Madras High Court has stayed at the Southern NGT bench order transferring the case of coal imports to Delhi said it was ‘Pan India’.

Any NGT bench will have more jurisdiction than the specified area and no power determined for what benches Even though the northern zone bench in Delhi was called the main bench, it was Prima Facie contrary to the NGT Act scheme because the action was not talking about the principal’s bench.
“The decision given by the NGT bench, dealing with any problems, will have an effect PAN India and cannot be said that only if the problem was decided by the bench in Delhi, it would have a Pan India effect, the judges said.
The problem related to the request that was moved to challenge the order passed by the southern bench NGT on 15 Jun 15 transferring the case to the principal’s bench because the southern bench felt that the command to be forwarded to the petition would have the Indian Pan effect and had to be heard by the school head bench in New Delhi.
The applicant challenged the official memorandum of the central government on November 11, 2020 by stating that there was no assessment of the fresh environmental impact needed if there was a change in coal sources by the industry.
It is a change in the source of imported coal to domestic coal or domestic coal to import coal or a mixture of both coals for the use of thermal power plants.
The applicant accused that such a move would have a big impact on the environment.
When the request came to hear, the southern bench did not argue that the principal’s bench could run power over all India in addition to training their strength in their jurisdiction.
Refusing to swear, the High Court said, “People expect sending justice in their door steps to be extended to the highest level.
The purpose of building court benches in each zone is to decide on the problems arising from the specified country.” Nothing The Indian Pan concept available in the law, said the court while still ordering a transfer.
