ALLAHABAD: The Allahabad high court has refused to provide custody of a little’husband’ for his’wife’, claiming that their union was voidable and doing this could amount into sanctioning cohabitation between a major and a minor.
Since the 16-year-old is reluctant to reside with his mom, the court didn’t provide his custody for her .
It led police to organize for the boy remain in a country center such as a protector home until February 4, 2022 once he attains the age of’bulk’.

Justice J J Munir handed the order while permitting the request filed with the boy’s mother, a native of Azamgarh, who’d promised her son’s custody.

The court stated,”The POCSO Act leaves cohabitation of a small boy having a significant woman an offencethat will surely be dedicated, when the boy is from the custody of his spouse.” “The prosecution or maintenance of a little, which inherently creates or has the capacity of creating the small the casualty of an offence and his own mature protector a criminal under the Act of 2012 (POCSO Act), cannot be considered a prosecution or arrangement designed to guarantee the welfare of the small,” it added.
