Ahmedabad: Widow a retired army knocked on the door of the Gujarat High Court on Thursday, after the Army denied his family retirement on the grounds that he was his second wife.
The petition was submitted by the 76-year-old Lalitaben Patel and Divorcee Hetalben’s daughter, both residents of Adalaaj, looking for clues to the center and Sena Seva Corps to give them retirement who retired Prabhudas Patel soldiers used to death in December 2019.
According to Advocate Applicant Girish Patel , Prabhudas Patel was born in 1943 in Kenya and grew up in African countries.
Upon returning to India, he was recruited to the troops in February 1963.
He married one Tarulata Chavda in a letter in 1972.
But eight days later, he left and his existence was not found.
Patel married for the second time to Lalitaben in 1977.
They have two daughters.
He left the army in 1978 and then received the work of a guard with the state government department, from where he retired in 2003.
He drew retirement for the work of the state government with the army.
After the death of Patel, his widow began receiving family pensions from the state government, but the army did not give it.
He asked for a family retirement, but was rejected on the ground that he was the second wife of the retired service book and Patel had the first wife’s name.
The widow wrote a variety of letters to the Sainik Welfare Office and resettlement which stated that they did not know the existence of the first wife, he had never claimed to retire from one of the departments to date.
He also placed previous communication made by Patel on Record, where retired soldiers had requested the central department to make arrangements to provide retirement to Lalitaben after his death.
He has made several requests to change notes, where his first wife’s name was mentioned.
After waiting for a positive response for several years, the widow and Divorce’s daughter filed a petition in the High Court and handed over that after Tarulata left Patel, the latter, caught that he would leave the country and notify the district collectors.
Regional passport offices are also intimidated with requests to stop leaving the country.
The applicant has placed communication at a record with the letters written by Patel to enter the second wife’s name for the retirement scheme.
The applicant also states that if the first wife claims to retire, they will return the amount with interest.
After the preliminary hearing, the je-desai judicial and justice A thaker acknowledged the petition and searched for a reply from the authorities on October 11, when the hearing was further posted.
