Thiruvananthapuram: The opposition congress on Wednesday urged the resignation of the Minister of Education Kerala after the Supreme Court rejected the state government’s request that was seeking a criminal case with LDF MLAS, including V Sivankutty, in connection with the commotion in the State Assembly in 2015.
The leader of the Senior Congress of Ramesh Chennithala, who conducted a legal battle that was looking for a MLA trial involved in the commotion, urged the Head of Pinarayi Vijayan’s minister to immediately seek Sivankutty’s resignation immediately remembering the Supreme Court’s verdict.
Other UDF leaders include Congress’ K Sudhakanan, Satheesan VD and Muslim League leaders P K Kunhalikty and State President BJP K Surendran also said Sivankutty must immediately retreat.
They say Sivankutty does not have moral rights to continue as ministers.
However, Sivankutty indicated that he would not resign because the APEX court had not made observations that guaranteed his resignation.
In his assessment, the court observed that the right to freedom of speech and the privileges of parliamentarians did not extend immunity to criminal law.
It is said that the destruction of public property cannot be equated with an important exercise to release function as a member of the house.
The State Assembly has witnessed an unprecedented scene on March 13, 2015 as a member of the LDF, then in the opposition, trying to prevent the Minister of Finance K M Mani, who faced charges at the bribery bar, from presenting the state budget.
In addition to throwing speaker chairs from podiums, electronic equipment such as computers, keyboards and Mikes on the chairman’s official table are also allegedly damaged by LDF members.
In the request submitted in the upper court against the order of March 12, the High Court, the Kerala government has claimed that the High Court has failed to appreciate that the alleged incident occurred while the Assembly was in the session and no crime could be registered “without previous sanctions” from the speaker.
