Prasagraj: deny the assurance of anticipatory for the allegations of rape, which allegedly established a physical relationship with a woman on a fake marriage promise after meeting her on a dating site, Allahabad High Court has observed that active on a dating site is not a parameter to assess someone’s virtue.
The affirmation of this court came in response to the argument submitted by advisors for the applicant accused, who seek to draw assumptions as easy virtues from the victim women while trying to get consensual sex theory.
In this case, the victim and the defendant had met on a dating site and allegedly, at a false promise to get married, the defendant had sexual relations with him.
After that, he returned to his promise which led to the registration of the instant case against him by the woman.
It was handed over in the name of the Petitioner that he and the victim met on a dating site.
Given this fact, it was conveyed that within four days of their meeting, the formation of a physical relationship by the victim showed that it was a consensual sex case.
It also argues that there is no talk about marriage between the two and, therefore, the allegations that they have pampered themselves in physical relationships in the name of the marriage proposal not made.
Refusing to consider the theory of gender consensual advanced by the Petitioner’s advisor, the court in his decision dated September 14 observed, “Dating sites are not an indication of having judgment on anyone’s virtue.
Only, two adults meet on a dating site, and on the third day meet him , Exchange of words can gather confidence that other parties are willing to marry and on behalf of marriage, if physical assistance is sought, then it will not mean to characterize the victim, as a problematic person who approves physical relationships without any provocation such as promising.
” While rejecting the anticipatory guarantee application from One Abhhey Chopra from Gautam Budh Nagar (Noida), Vivek Agarwal justice said that the applicant was free to give up before the court below and participate in the court process.
“He might also, if it is recommended, file a regular guarantee, what the court pay attention to his own ability, without prejudiced from the commands skipped here,” the court added.
