New Delhi: By pointing to Mombang Roy, BJP MLA who rejoined the Trinamool Congress (TMC) last month, as Chair of the Public Account Committee (PAC), West Bengal Banerjee Bengal Assembly Speaker may have avoided the norms and services set.
But also constitutional provisions, according to experts.
Mapping Roy, who is TMC Rajya Sabha MP, has joined BJP in 2017.
He rose to become the National Vice President of BJP.
In the election of the West Bengal Assembly held in March and April, he fought BJP tickets from the constituency of North Krishnanagar and won.
However, he came out of BJP and rejoined TMC last month in front of the State Minister and Party Supremo Mamata Banerjee.
Last month itself, BJP Mlaas filed an assembly speaker petition demanded Disqualification Roy when he joined TMC without resigning from their side.
But instead of making a decision on the request of BJP MLA, the speaker stepped forward and appointed Roy as chairman of PAC.
Post usually goes to opposition leader.
While BJP demanded the appointment of one of the MLA to the post, the powerful TMC said Roy was technically MLA from the opposition party at home.
The speaker’s actions pushed the opposition leader at the State Assembly of Suvendu Adhikari to meet Jagdeep Governor Dhankhar on Tuesday.
He demanded Ouster of Roy as chairman of PAC.
As a sign of protest, BJP MLA also resigned from eight different home committees.
BJP MLA can also apply for President of RAM Nath Kovind and Lok Sabha Speaker Om Birla against Roy’s appointment as the head of the key house panel in the coming days.
Speaking with Timesofindia.com, experts blamed West Bengal Banner Banerjee speakers to appoint Mombang Roy as chairman of PAC.
The constitutional expert and former Secretary General Lok Sabha Pdt Achary said, “The speaker must decide on the problem of disqualification first before pointing at him (Roy) as chairman of the PAC.
There is no point in giving him a position without disconnecting the disqualification petition.” A former top officer of the Election Commission said about the condition Anonymity that the speaker is guilty.
“If you see it as an independent incident, BJP is right in demanding Roy’s elimination as chairman of the PAC.
The speaker must prosecute the problem of disqualification first.
He must give a reason to accept or reject the BJP petition.” The officers quoted the tenth constitutional schedule and said Roy should automatically be automatically disqualified As Mla to join TMC.
The speaker should make an announcement for this effect.
The officer also showed that a unique situation had emerged from the speaker’s decision.
“If the speaker will be analyzed, Banging Roy holds a double party membership.
He is technically MLA BJP in the house and MLA TMC outside.” Holds the appointment of Roy as Head of PAC as wrong, nationally responsible for the BJP and Information Technology Department and CO.
-Incharge from West Bengal Amit Malviya also expects a speaker to try the problem of disqualification first.
“The speaker cannot continue to sit on the petition.
He must give a reason not to disqualify Roy,” he said.
The source said the BJP can move the court to the speaker’s decision if Roy is not disqualified as MLA.
