B’luru: RC transfer is enough to get insurance

Bengaluru: Transfer Vehicle Registration Certificate (RC) from the owner to the buyer is enough to provide benefits, including a motor insurance policy, the Consumer Court has ruled.
The court also ordered an insurance company to clear the accident’s claim about almost Rs 6.6 lakh and paid compensation of Rs 60,000 to a man who had bought a car and got his RC transferred to his name but not an insurance policy.
Mysuru Resident Abishek R Das, 25, bought a Hyundai Verna car from Sheeba Robert in October 2019.
On October 10, the watershed got RC transferred to his name and planned to transfer insurance paper in a 14-day period.
But on October 12, his acquaintances drove a car and caused a serious accident, requiring more repair costs than Rs 6 Lakh.
With a car policy under United India Insurance Company Ltd.
Active from January 16, 2019, until January 15, 2020, on behalf of Robert’s previous owner, DAS raised accident claims.
While a surveyor was sent to assess the damage to the car, the company refused the claim, stating that there was no contract between Das and United India and was not responsible for paying.
DAS Approaching the additional district regency requires a redressal commission with complaints against United India insurance on August 7, 2020.
His lawyer presented his case while representative of Bengaloro Insurers failed to emerge.
Chennai’s colleagues insurance company against the case through their lawyers who claimed that the complaint was wrong.
The lawyer argued that the insurance policy was on behalf of Sheeba, the first car owner, and the watershed was not in the picture.
However, the Consumer Court quoted the Supreme Court’s verdict in similar cases where the second owner, as in section 157 of motorized vehicle action, enjoyed certain benefits, including insurance protection, if he transferred RC to his name.
The court showed that the accident had occurred two days after RC’s transfer.
In its decision on November 18, 2021, the court believes that insurance companies that indicate claims of watershed accidents on active policy are clear service deficiencies.
It asks the insurance company to pay Rs 6,58,432 with interest in car repair and an additional amount of Rs 25,000 (because it causes discomfort), rs 25,000 (damage) and rs 10,000 (court fees).
