New Delhi: The Delhi Court has denied guarantees to a bodybuilder accused of raping a woman with a false promise of marriage and threatening to make their intimate video viral.
A 38-year-old married woman alleged that the defendant Faizan Khan made a physical relationship with the pretext of false marriage promises, demanding money, making a video, starting to ignore it after he was pregnant, and threatened that he would leak it video if he revealed the relationship with anyone.
According to complaints, he continued to increase him and when he revealed this to her husband, he was overthrown from the house of the matrimonial words.
He claimed that he then went to Bengaluru and tried to commit suicide but with someone intervention, approached the police to file a complaint.
Denying relief, the additional session of Prashant Sharma Judge said, “The accused of accused of being accused of being accused and other circumstances of this case, accused of Faizan Khan was not entitled to a guarantee.” The defendant had sought guarantees on the ground that the woman had sexual intercourse with him voluntarily and he did not demand money from him.
He said that the time or date or the alleged alleged place was mentioned in FIR who filed his complaint.
Khan, nested in prison since December 4, 2021, also said that there was an uncontrolled delay and could not be explained in the FIR Inn.
He said the woman was not looking for help from the police and his complaint was reflection.
He also fought it over that the complainant was pregnant.
On the other hand, the complainant through Advocates Sahil Mongia believes that the agreement given by it is not free, but under the guarantee that he will marry him.
“The approval of Prosecutrix is ​​obtained with a misunderstanding of such facts and agreement is there is no consent when it is based on the mistake of presentation because the lack of physical endurance by Prosecutrix cannot be considered an agreement for sexual activity,” Mongia said.
He added that the defendant was a bodybuilder who could threaten his client with a terrible consequence if enlarged in guarantees.
