Mumbai: In the first step towards peaceful settlement with the help of the Bombay High Court, the owner with Iconic Yazdani Bakery in the fort had agreed to submit a bungalow key in Pune to his mother so he could stay there, Rosy Sequeira reported.
Pervin Zend has transferred a holiday bench from Judge Shahrukh Kathawalla and Surendra Tavade to direct the youngest son, Zyros, to obey the orders authorized by the welfare and maintenance of parents and tribunal senior citizens.
He specifically urged for the key Villa Parvati at the property of 44,385 sq ft at Pune Cantonment.
“He has the right to go and stay there.
A shame! The 84-year-old mother had to knock on the court and court for the prize given to her son,” said Justice Kathawalla in November 5.
He asked that the mother remained present.
The problem was then heard in the room and Pervin was taken to court in a wheelchair.
Family line: Urgpervin peaceful settlement is married to Zend Merwan Zend.
Their marriage was dissolved on September 25, 1981 by the Head of Parsi Matrimonial Court.
They have four children-zorast, Perzon, Zyros and Princess Maniz Bhimra.
Zend died on January 10, 2021.
Pervin has transferred the court against Zyros “Snatch / trying to seize some of my assets without my free will and approval”.
On September 27, 2021 the court allowed his complaint and stated that two actions registered null gifts and canceled.
The first is June 30, 2013 in connection with the Avijah Building in Dhobi Talao and the second, May 27, 2015 in connection with Pune property.
It directs the Deputy Registrar (Mumbai City) and a shared panel, Pune, to restore Pervin’s name in this property within 30 days.
The court also directed Zyros to return Rs 1.72 Crore (withdrawal and transfer from a pervin account) with a compound interest of 8% per year from October 31, 2018 and so on.
It is also directed to remove the Zyros name of all bank accounts and lockers and for Zyros to return the debit card and its original credit, check the book and a fixed deposit.
Zyros challenges orders on HC.
His petition said the court passed him for no reason.
Another bench on October 28, in a temporary order, directed the parties to maintain the status quo in connection with Pune and Mumbai property.
Therefore Pervin moved the HC holiday court.
In November 8, the judges said they interviewed Pervin and his children, including Zyros.
“Because the dispute in the writing petition above (by Zyros) is among family members who are very close, we have tried to advise the parties before us and have helped them in appreciating that friendly settlement between them is preferred than a prolonged legal battle , “said the court.
The judges noted that Zyros handed over the key paste bungalows “to allow his mother to visit the same and stay there as long as he wanted with children and other family members according to his wisdom”.
After returning from Pune, he will hand over the key in court.
“As long as he lives, the Petitioner (Zyros) will not bother him in any way and will not visit the bungalow during his stay,” added the judges.
They direct that “the status quo must be maintained by the parties in connection with all moving and non-moving properties belonging to the mother, exclusively and / or where it has a part”.
They also directed the HC registry to take the chairman of the Chief Justice to treat this problem as a part that was heard and “continued with efforts to help parties in settlement”.
