Mumbai: The Bombay High Court on Friday triggered a guarantee to a 28-year-old child who was arrested on charges associated with Terror Outfit Islamic State (ISIS).
The Division of Judge S Shinde and N J Jamadar allowed the petition submitted by Iqbal Ahmed Kabir Ahmed challenging a special court order that rejected his guarantee.
“The order delivered by a special court canceled.
The Applicant (Ahmed) will be released on the guarantee after completing the RS one lakh bond and one or two guaranteed solvents with the same amount,” bench said.
The court directed Ahmed to appear in the presence of the National Investigation Agency (NIA) twice a week for the first month and then once a week for the next two months.
“The applicant will attend every date of the trial and will not hamper or contact witnesses in this case,” Bench said.
Ahmed was arrested on August 7, 2016 and ordered under the tight provisions of Act (Precent) Act (UPA) to be part of Terror clothing and under the Indian Criminal Code (IPC).
The prosecution case is that Ahmed is part of the ‘Parbhani’ module ‘ISIS, which is said to plan to carry out a terror attack at the police supervisor office in Parbhani.
Advocate Ahmed Mihir Desai argues that there is no evidence of the applicant and that the trial in this case has not yet begun and there are more than 150 witnesses to be examined.
