Mumbai: Badi Bombay High Court holidays on Monday direct BMC, central, country and other authorities to submit a reply within a week in pills submitted by two IIT-B research students for judicial intervention on damage to the cycle song project.
Justice S J Kathawalla directed the applicant through Rajmani Varma’s advice along with Advocate Prayushi Kapadia to propose whether back in three days afterwards and posted this problem until November 16, to be placed before the reserve of justice.
The court asked BMC not to carry out cycle trajectory activities until then.
Varma said HC in 2013 directed that on the ‘wetlands’ in the Atla central wetland, there would be no reclamation and no construction without a court nod.
He showed HC’s balance under the DCR and proposed that it mentioned that “to prevent soil erosion and raise the lake, the exclusive green belt of 100 m will be provided around the edge of the vihar and powai lake, where no construction is allowed”.
Senior advice Aspi Chinoy appears for BMC and opposes pills, questioning the filing of applicants and ‘wetlands’ arguments, saying it is a man-made reservoir and the project in the public interest.
BMC said it was a ‘natural area’ and under the DCR, agreed to put the path Cycle.
Jyoti Chavan, government lawyer, look for time to submit a reply when HC asks if the lake is part of a wetland.
