New Delhi: Relieves to a home buyer who is forced to take their flat and start living because of the delay in the builder to get all the permits from the authorities, the Supreme Court on Tuesday is held for lack of service in the part of the real estate company if it fails to get a job certificate and Home buyers can search for compensation.
Judge D y Chandrachud and a Bopanna said the builder would be responsible for returning money if home buyers were forced to pay higher taxes and water costs arising from the lack of residential certificates.
This set aside the order of the National Consumer Disputes Negial Commission which has rejected a home buyer’s request against the builder and held they must approach the authorities that charge higher taxes.
SC delivered an order on the Petition of Samruddhi Co-operative Society Ltd.
based in Mumbai Ltd Advocate Sunil Fernandes, said buyers of houses in the community for 25 years without occupation certificates and had to pay 25% higher property tax and 50% water costs.
Builder said the request was banned by limitations because the cause of the action appeared in 1997 when they took ownership but the complaint was put forward 18 years later.
