New Delhi: The Supreme Court on Friday was held that it was obliged to collect cadres that could be measured by being unable to represent the scheduled caste and tribes scheduled in government work before giving reservations to them.
However, by holding back not to give benchmarks to decide inadequate representations and leave it for the government to make calls.
Judge L Nageswara Rao, Sanjiv Khanna and B R Gavai believes that all services or service classes cannot be taken to become units and are treated as cadres for the purpose of collecting data that can be quantified to provide reservations in promotion.
“Before providing reservations in promotion to cadres, the state is obliged to collect data that can be measured regarding the inability of SCS and STS representatives.
Collection of information about the inability of SCS and STS representatives cannot be able to refer to all services or ‘class’ / ‘groups’ but must be able to Revived with the Post Class / Category Where the promotion is sought.
cadres, which must be a unit for the purpose of collecting data that can be measured in connection with promotional posts, will not mean whether the data related to the SCS and STS representation is to refer to all services, ” he said.
It is said that the state must justify the reservation in the promotion regarding the cadres promoted promotions.
“Considering data relating to the ‘group’, which will be an incorporation of certain cadres in a service, will not provide a correct picture of the inability of SCS and STS representation in cadres relating to the promotion to be searched for,” Bench said.
The main stumbling block for the country to provide reservations in promotion is the lack of adequate data about the representation of SCS / STS in different cadres.
In accordance with its center, there are more than 5000 cadres at the central government work in 90 ministries / departments where 30 Lakh employees work.
Referring to the information received from 44 ministries / departments from 90, the center has stated that there are around 3800 cadres and submitted before the court that he has data about SCS / STS representation in different jobs – class I, II, II and IV classes It’s hard to collect cadre-wise data.
It has submitted that the adequacy of different representations in different work classes with a higher percentage in class III and class IV, but very low in class I.
