New Delhi: Cairn Energy has dropped lawsuits against the government and its entities in the US and Britain.
This is in the final stage of withdrawal of cases in France and the Netherlands, which was submitted to return around RS 7,900 Crore collected from him to enforce retrospective tax requests.
As part of the settlement achieved by the government to seven-year old disputes over back tax retribution, the British company has begun the process to withdraw lawsuits that have been submitted in several jurisdictions to uphold the international arbitration award, which has canceled RS 10,247 retribution of retrospective tax and ordered India to return the money that has been collected.
Two sources with direct knowledge of the problem said Cairn on November 26 attracted a lawsuit brought by Mauritius for recognition of the arbitration award and took similar steps in court in Singapore, England and Canada.
On December 15, it was sought and got a ‘voluntary dismissal’ of the lawsuit brought in New York court to seize Indian Air Assets to recover money because of the government.
On the same day, it made a similar step in the Washington court where he was seeking recognition of the arbitration award.
Recognition of Arbitration Award is the first step before the law enforcement process such as confiscation of assets can be carried.
The source said a critical lawsuit in the French court, which has attached India’s nature to the Cairn request, was in the final stages of withdrawal.
Paper work is expected to be completed in the next few days.
The attachment of Indian assets, including several flats in Paris, in July used by Indian government staff have triggered the 2012 amendment scrapping on income tax laws that gave tax power to return 50 years and slapped the increase in capital where ownership had changed hands abroad But business assets are in India.
