PANAJI: In a case relationship to 2019 about an’prohibited’ arrangement near the turtle nesting site in Morjim, the National Green Tribunal has stated that demolition could only be arranged if a construction was assembled after 1991 or can be situated inside the no development zone of CRZ.
Back in July 2019, the Goa Coastal Zone Management Authority (GCZMA) issued a demolition order from the’prohibited’ structures possessed by a guest home to the Morjim shore in Pernem taluka.
The NGT has asked the GCZMA to rethink the situation though the region is near the sensitive turtle nesting website.
The guest property owner had approached the NGT from the GCZMA’s demolition order.
The alleged violator stated that the GCZMA had arranged the demolition mentioning the tribunal’s order on turtle nesting sites.
The guesthouse owner stated that the purchase was incorrectly implemented in his situation.
The NGT disposed of this thing allowing the guesthouse owner to transfer the GCZMA within a month to get an overview of this situation.
“We notice that the region in question is being near turtle nesting sites, however, the demolition is permissible only if the structure is article February 19, 1991, also at virtually no development zone.
Needless to state the GCZMA should follow due process of law before passing the order in the subject.
GCZMA may finalise the issue so far as possible in just three weeks,” that the GCZMA said in its purchase.
The NGT stated that it has to be analyzed from case by GCZMA if the arrangement arranged to be demolished was present before the 1991 CRZ notification and if it stands inside the no development zone.
“No discovering seems to have been documented regarding the impugned structures being post-1991 and inside NDZ.
The impugned arrangement cannot thus be permitted to reach finality without additional consideration,” that the NGT stated.
The tribunal stated the GCZMA has the freedom to transfer the NGT if it’s aggrieved by the arrangement.
