Mumbai: The Central Investigation Bureau opposed the PLEA Bail Bail Chhota Rajan in the Bombay High Court on Wednesday and said the gangster did not respect the country’s law.
The Special Public Prosecutor Pardeeep Gharat said the single bench led by Justice Anuja Prabhudesai that Rajan had several cases delayed and punished and punished in a number of other cases.
Ghārat urged a high court to not provide guarantees to Rajan, said the gangster was “Z plus a security threat”.
He said that Rajan had escaped from India and traveled to several other countries about fake names and passports before he was finally arrested and extradited to India in November 2015.
Rajan was extradited from Indonesia in 2015 and has been detained in Tihar prison in New Delhi.
Gharat made a submission that opposed the temporary application submitted by Rajan, looking for guarantees in the case of attempts to kill a hoteler.
Rajan was sentenced to prison for eight years in this case by a special court in Mumbai in 2019 under the control of Maharashtra for the organized crime law (McOCA).
However, Rajan’s advisor, Senior Advocate Sudeep Pasherit, told HC that there was no credible evidence of gangsters in this case.
“I (Rajan) have been punished for allegations of conspiracy.
Everyone accuses people in this case, including those who are actual attackers, have come out with guarantees, so I deserve parity,” said Pasbola to HC.
“There is no direct evidence for me.
Only the definition statement by two witnesses, which is not based on their personal knowledge, quoted as proof of me.
This statement is based on the information provided by one of the charges with them, who escaped,” said Pasbola , Gharat, however, told HC that while Rajan was in CBI custody in this case since April 2016, the accusation, which guarantees, was detained since 2009.
In addition, Rajan still has 14 to 15 cases delayed by him, said Gharat.
“The applicant currently does not respect Indian law.
He fled to various countries.
He traveled with a fake name and a fake passport.
He was arrested after his original identity was found.
And then, he was taken to India in 2015,” said Gharat.
“He (Rajan) has 71 cases against him before the CBI …
14-15 (case) is still delayed.
He has been punished and punished in 12 cases and gives life imprisonment in one of these cases,” he said.
Prabhudesai justice directs the CBI to submit before the HC as a copy of FIR, a statement of witnesses recognition in this case, and a list of criminal antecedents of Rajan.
HC will continue to hear the request after two weeks.
On July 14, Prabhudesai justice has admitted to hearing many applications and interim submitted by Rajan, looking for guarantee rights and challenging confidence in three cases.
In these two cases, Rajan, whose real name is Rajendra Nikalje, is convicted of trying to kill.
Rajan was sentenced to eight years in prison in terms of attempts to kill Hoteler BR Shetty in August 2019.
He also challenged the orders of the Special CBI court that sentenced him to two years in January 2021 in the 2015 extortion case.
He also appealed to his 10-year confidence and punishment, said by The court in March this year, because they tried to kill Builder Ajay Gudisasi.
