CENTER MOVES SC Look for Extension Time to frame Guidelines for Covid Ex-Gratia

New Delhi: This center has moved the Supreme Court who is looking for an extension of the time given by the APEX court to the National Disaster Management Authority (NDMA) against the frame guidelines for ex-gratia compensation to families who died for four weeks.
, The APEX court on June 30 directed NDMA to recommend within six weeks.
The right guidelines for the help of ex-gratia because of losing life to family members of the people who died of Covid-19.
The center in the application says that the exercises that are in the active consideration of NDMA are at the advanced stage and need a slightly deep inspection.
“The Petitioner (Union of India) Dear Sirs submitted the exercise to frame the right guidelines for payment of ex-Gratia payments to the victims of the Covid-19 disaster below the Section 12 (III) DMA (disaster management law) in the active consideration of NDMA and happened, “said a request, drawn by Advocates Rajat Nair.
“It was submitted this exercise, although at the active increase stage, requires a slightly deeper inspection before the same thing is finalized and implemented.
Each accelerated formulation, in the submission of a respectable applicant, can lead to unwanted results,” it said.
The center urges the upper court to give four more weeks to frame the guidelines.
In its verdict June 30, the Top Court also ordered steps to simplify the guidelines and corrections “Official Death / Document Certificates stating the exact cause of death, namely, ‘Death because it allows its dependents – 19’ to enable responsibility to get the benefits of the welfare scheme.
However, the court The peak has noted “peculiarities and impacts and effects” pandemic and say that it cannot order payment of RS 4 Lakh as ex-gratia compensation that must be decided by NDMA because there is a need to “focus simultaneously on prevention, preparedness, mitigation and recovery, which call for a different mailing of mobilization of financial and technical resources “.” We direct NDMA to recommend a guide for the help of Ex Gratia because of losing life to family members of the people who died because of Covid-19, as the mandate below section 12 (iii) for Disaster (DMA) 2005 for Minimum Standards of Aid Yan G will be given to people affected by disaster – Covid 19 pandemic, exceeding and above the guidelines have been recommended for the minimum standard of assistance that will be given to people affected by Covid-19, “he said.
It also directs the center to take the right steps on the recommendation of the Financial Commission to provide insurance protection for death caused by Covid.
The direction has come after the center says that currently there is no “guidelines / policies / schemes in NDMA relating to the national insurance mechanism that can be used to pay disaster-related deaths due to covid”.
