Ahmedabad: The Gujarat High Court has issued a summons to BJP MLA Nimisha Suthar and the Indian Commission’s election in the Petition submitted by Suresh Katara Congress who loses from Suthar, challenging the caste certificate submitted for the Morva Hidaf Constitution, which is provided for the scheduled tribal candidate.
Justice Nikhil S Kariel on Monday issued a summons to Suthar and other respondents, including election officers and Indian election election commissions, with the provisions of the representation of the People’s Law, and asked them to appear before HC in 2.
Suthar won the selection of by-election The constituency of the Hadaf Morva Assembly (in the Panchmahals district), is intended for the Transportation of Tribe (ST) scheduled, on May 2 this year, defeating Katara’s rival Congress.
Katara recently submitted an election petition in HC, looking for directions to set aside the selection of Suthar, accusing a certificate of caste submitted by Him to EC was “wrong and not varied”.
Suthar has won by-achievement selection, is required for the death of MLA Independent Bhupendra Khant in January this year.
Certificate of Castle Khant was previously invalid by the Gujarat government, after that he was disqualified as MLA.
Khant challenged the governor’s decision to disqualify him, who was waiting in court before being considered to reach out and throw after his death.
In his request, Katara claimed that Suthar did not belong to the ST community and the caste certificate was wrong and delivered without verification.
The applicant said he had made a representation of the form of Suthar’s nomination before the officer returned before the Bypoll, but the officer rejected his objections “without appropriate appreciation to the facts”, and received the BJP leader nomination.
“Respondents (Suthar) are not members of St and the caste certificate issued in his help are clearly wrong and submitted without verification,” Katara said in his request.
He alleged that MLA robbed a person’s original rights through his fraudulent actions.
