NEW DELHI: To shore up the justice delivery method, groaning under the load of three crore pending instances, Chief Justice of India N V Ramana has introduced an ambitious plan to establish a National Judicial Infrastructure Corporation (NJIC) to develop modern and self explanatory judicial infrastructure around India.
From the two-day-long deliberations using higher court chief justices in four periods on June 2 and 1, the CJI said bad infrastructure has been demonstrated to be a significant stumbling block in shipping of justice and also shared his vision for production of NJIC, which according to him will be tasked to assemble”detailed, self indulgent, comprehensive and contemporary court complexes throughout the nation to fortify judicial structures”.
Though many CJIs before two decades have emphasized that the deficient infrastructure, particularly in smaller cities and rural locations, as a significant stumbling block for accelerated delivery of justice, the judiciary had consistently stayed dependent on the winner of both central and state authorities for grants to strengthen its infrastructure, for example, usage of information technologies.
The proposal for production of NJIC seems timely, but will depend on what attributes it will have in its final form and the control below which it will assemble contemporary court complexes.
Justice Ramana’s strategy envisages the NJIC is going to be handled by a CJI-led committee containing SC judges who’d eventually become CJIs later on.
The NJIC handling committee may also have fund secretaries into the Union/state authorities and HC CJs with long tenures.
Under the new proposal, the states will be asked to fund contemporary court complexes via a one time grant.
The pandemic-caused disturbance of bodily hearings and judges working almost has given rise to the desperate demand for strengthening the video-conferencing approaches in trial courts, particularly in rural regions with connections to litigants.
A few HC CJs indicated cellular vans to establish relations between both judges and rural inhabitants.
The CJI consented to analyze the feasibility of these suggestions and incorporate them within their contemporary court complicated infrastructure.
Justice Ramana explained,”I’m of the firm belief that unless infrastructure has been reinforced, it’s unjust to expect courts, especially lower judges, to perform wonders and boost the speed of justice shipping.
Both quality and amount of justice can be made better only when service systems are powerful enough to meet the challenges”
