CMRL cannot punish commuters on masks: HC

Chennai: Chennai Metro Rail Limited (CMRL) cannot collect Rs 200 as a penalty on commuters found without a mask because Madras High Court has resisted CMRL because he wants authority.
“The best intended action, which is not supported by legal authority, is not resistant.
Even though the CMRL intention should be praised, it does not have the authority to impose and collect fine,” said the court on Thursday.
The first bench of the chairman of Judge Sanjib Banerjee and Justice PD Aucikesavalu, continuing the order on the pill moved by Advocates R Muthukrishnan, said: “…
The authority to force a penalty as it cannot be adjusted to the CMRL that regulates the CMRL expressly jurisdiction about such a body to impose Penalty.
“If at all, the state may have imposed such a penalty, assuming that the next and valid validity and valid regulations by treating the Metro Station and Metro coach as a public place.
However, only because the country has the authority to force a penalty, it will not imply that CMRL can draw from there or have the strength or jurisdiction to impose a fine fine, but the same good intentions, the court added.
Regarding the 87,000 RS penalty has been collected by CMRL, the court said, “Because the quantum seems to be a bit, CMRL is allowed to maintain the amount and according to the same because it is fine it is not possible to find people fined enforced and even people like It may no longer be interested in recovering the same.
“The applicant challenged the validity of the press release issued by CMRL on April 10 which told the public that the RS 200 fines will be charged on commuters found not wearing a face mask in accordance with the Covid-19 protocol.
