‘Compensate Kalyan Nagar Society, Cover market rate’

HYDERABAD: Coming down heavily onto the consecutive authorities for failing to safeguard 38 acres of property belonging to both Kalyan Nagar Cooperative Housing Society at Yousufguda, the high court has led the Telangana authorities to cover the society prevailing market worth and slapped prices of Rs two lakh.
The present market value of this property may be anywhere between Rs 1,500 crore and Rs 2,000 crore and the nation was requested to cough up this sum and pay it into the society over 2 months.
The court has also directed the state to choose the terms of this 2013 Land Acquisition Act while calculating the market value.
A seat of Justice M S Ramachandra Rao and Justice T Vinod Kumar declared this arrangement when placing in the rest a practically six-decade-old legal tussle.
Kalyan Nagar Cooperative Housing Society was enrolled in 1963 by 350 members in the lower middle class and middle class households.
It had bought 38 yards along with 2,121 square yards of land in Yousufguda in poll No.128/1 and 128/10 at January, 1964 by a few men.
About March 1, 1978, the manager of city planning and Municipal Corporation of Hyderabad (currently GHMC) had approved the design of this Society.
But, sale deeds couldn’t be implemented in favor of their members/allottees in light of this prohibition under the Urban Land (Ceiling and Regulation) Act, 1976.
The society’s property has been exempted from the purview of this Land Ceiling Act in February, 1988.
On the other hand, the harm has been done by then.
Because of the enormous delay caused by the procedure, the property had been encroached upon by 503 people with the support of this then-local MLA P Janardhan Reddy.
After hearing the request filed with the society, all 503 residents of those plots were announced by the property catching prohibition courtroom as property grabbers on September 19, 1989.
The purchase wasn’t contested from the so-called grabbers, and therefore this arrangement reached finality.
On the other hand, the society’s real troubles started from then.
The then-government never bothered to enforce the court order.
On the flip side, they requested the society to get it in the grabbers.
The bad society was prepared to do this too.
That wasn’t done.
The country said it would provide alternate land.
This was not done.
The seat found fault with the state authorities for dodging the problem for two years after recognising the necessity to compensate for the home society.
