Nagpur: Ashwin Prakash Mehadia, President of the Commercial Chamber of Nagpur Vidarbha (NVCC), who is the peak body of 13 regional Lakh traders and a public limited company, has held his position since two years despite the identification number of his Director (DIN) is disqualified five years ago for reasons that did not Published publicly.
He is also not on the Board of Directors (BOD) of NVCC, which must be in accordance with the room guidelines.
The problem arose after the Vice President of NVCC Arjundas Ahuja filed a complaint with Guardian Minister Nitin Raut on October 23.
He demanded a violation registered with Mehadia, all decisions taken by him were ruled out by the NVCC in the last two years being canceled, and the new selection was held.
The election for the president and another post is held every year.
“Mehadia did not reveal to the NVCC about Din disqualification.
He told me to remain silent and convincing that I would be a president.
He has cheated rooms for two years,” Ahuja wrote in his complaint.
In accordance with the Corporate Ministry (MCA), Din Mehadia Din 02910003 was below disqualification from 1 November 2016 to 31 October 2021.
In MCA, the name Mehadia was registered with agrawal as a family name.
According to Advocate Anil Kumar Mulchandani, “DIN must be appointed as a director at any company under the company Act 2013.
Also, no one can be designated again as director under disqualification.” Accepting that the din-eating was disqualified, said Mehadia, “I am not the director at NVCC.
My appointment is as president, who is the appointment of the organization according to the hierarchy.
In the company’s actions, the appointment of the chairman is mentioned and not about the President.
This is not a prerequisite that someone is appointed as President NVCC must be a director.

“According to Klausul No.
27 (a) The NVCC Articles of Association, the room will be managed by the Board of Directors consisting of the President, three vice presidents, secretaries, treasurer, three joint secretaries and pros.
According to Mulchandani, it is clear that the NVCC Articles of the Directors running the room and the President must be one of the directors.
“Any company must be carried out by the Board of Directors according to the Company Law too,” he said.
Mehadia was re-elected as president in the annual general body meeting held on October 20, 2020.
The presidential and other postal election was held in accordance with the provisions under the company’s laws which were clearly mentioned in the minutes of the meeting released on November 18, 2020.
Also, according to the document with Toi, Mehadia has signed a financial report submitted to the MCA as president.
Mulchandani feels it is a case of “imitation, oppression and irregularities and is responsible for imprisonment”.
“Every shareholder can challenge him before the national tribunal of the national company,” he said.
Records Show Mehadia uses this family name at letterhead and in several meetings.
In others, and with MCA, Mehadia became agrawal.
Mehadia said he had not created a separate identity and “therefore there are no questions about imitation”.
“It is a common practice to mention the caste instead of the family name.
I am included in the agrawal community and my name in a legal document is with the name of the family.
This does not give me specific benefits and there are no questions about rejecting the facts,” he said.
