Mumbai: The presence of condoms does not mean sex is consensual, the Mumbai session court has observed during the hearing of guarantees of the Navy staff arrested on charges of raping his partner’s wife.
“Just because the condom found at the scene is not enough to conclude that the complainant has a consensual relationship with the applicant.
The possibility of the defendant using condoms to avoid further complications cannot be ruled out,” said the court.
