Ahmedabad: The Gujarat High Court has requested the Center and Chair of the National Green Tribunal (NGT) to consider establishing a NGT circuit bench in Ahmedabad for the state of Gujarat.
It has been asked for a larger public interest so people are not forced to travel 700 km to bench pune, which has jurisdiction over Gujarat.
Justice bench J B Pardiwala and justice V D Navisati, “We may only observe that it will be in fitness things if the circuit bench was established in Ahmedabad, Gujarat state.” HC observations came in response to pills submitted six years ago by NGOs, the Consumer and Analytical Protection Committee, looking for directions to cancel current notifications that empower the court in Pune to hear cases of Gujarat.
Pills looked for the direction to the center to build a NGT bench in the Gujarat HC seat at Ahmedabad to face Gujarat environmental problems.
Advocate NGO Masoom Shah submitted that NGT had a circuit bench at Jodhpur, Shimla and Shillong.
One such circuit bench can be established in Ahmedabad because of people, especially the poor and tribes, feel very difficult and complicated to travel far to Pune and involve different state lawyers.
Advocate Shah quoted the assessment of the Supreme Court in the Swiss vs Union of India Case and insisted that permanent benches must be established when sitting every jurisdiction high court and, if it is impossible, at least a circuit bench must be set.
In Gujarat, it is preferred in Ahmedabad, so that those who disadvantaged can use the medicine without having trouble or difficulties.
After hearing this case, HC asked the concern authority to consider the problem in a larger public interest and made the right decision to establish a NGT circuit bench in Ahmedabad.
