Chandigarh: The National Commission for Twadul Castes (NCSC) has directed the Punjab government to consider orders in the promotion of justice officers and other court employees who are included in the scheduled caste category.
While hearing the petition highlighted the refusal of reservations in promotion to employees of SC in court throughout Punjab, Chairman of Commission Vijay Sampla asked the Punjab government to submit progress reports to the commission within two weeks.
During hearing which currently includes the Special Secretary of Punjab (home and justice) Baldeep Kaur, Registrar General Punjab and Haryana High Court Sanjeev Berry and Secretary with the Union of the Minister of Law and Justice of Anju Rathi Ranchi.
The Commission also expressed its displeasure of the fact that there was no concrete action taken on the recommendation of the commission in the previous hearing even after a long period of time.
Applicants who have approached the Commission have submitted that the state government has passed the laws – Punjab Castes Schedule and Reverse Classes (Reservations in Services) Act, 2006 – and in accordance with employees ACT Group A & B will get 14% of reservations, Group C and D will get a 20% order in promotion, but it has never been applied in the case of justice services and for other court employees.
Sampla said, “The Supreme Court in the State of Bihar and others vs.
Bal Mukund Saha and others (2000), held that the office or establishment of Bihar State Courts relating to the promise of public services and possibilities in relation to the state of the Bihar State Court will fall in the string of terms ‘establishment’.
In a similar line, the involvement of judicial officers and other court employees in various Punjab courts must be in the category ‘establishment’ state government.
“The Commission has now recommended that the Department of Houses in Punjab will soon move files for implementation, according to the rules reservation.
