Nagpur: In the order of landmarks, the additional district consumer disputes for the recovery forum here slapped the cost of Rs 26,000 in MSEDCL to decide on the power supply of a poor farmer.
The bench consisting of President of Vasudeo Patil and Member of Smita Chandekar and Avinash Prabhune observed that this case was submitted due to respondent’s indifference to customers and ignored legal provisions.
The Commission said it was a clear view that errors in respondent services were proven proven.
“The complainants must bear many mental, physical and emotional difficulties due to defects in opposing party services and must submit complaints,” said the judges.
The judges clarified that financial and other losses issued by MSEDCL must be investigated by competent authorities and RS26,000, alright must be restored from employees guilty while the report must be sent within three months.
They ordered a copy of the assessment to be sent to the Chief Engineer to prevent recurrence from these irregularities.
The original complaint was submitted by Mirabai Shiwankar, a resident of Kalmeshwar in Nagpur Regency.
After his death, his two sons Dhyaneshwar and Moreshwar were named in this case.
According to the complainant, MSEDCL issued their RS1,900 bill in September 2018.
After their protest, the bill was adjusted to the RS990 they paid.
In the following month, they again received a bill for Rs 1,720, which was then adjusted to the RS600 after negotiations between the two parties.
In December, they received RS1,500 bills carrying up arrears before, which was paid for the full Shiwankar family, according to the complainant.
However, on January 24, 2019, MSEDCL cut off their power supply.
The complainant then approached the forum which argued that they did not issue prior notice for termination.
Pray for the recovery of the power supply, they argue that MSEDCL issues a bill that increases based on the wrong meter and ignores the fact that their consumption is low.
Opposing their extension, respondents including the head, representative and junior engineer MSEDCL, showed that there was an irregularity in payment of the bill by complainants and they had issued a notification on November 9, 2018, under the Electricity Law, before taking the power supply.
While driving recovery in January 2019, it was known that the complainants had illegally reconnected power connections, thus pampering their theft, saying respondents and added that even police complaints were submitted to them at the conscious police station.
The judges explained that the complainants pay a fewer amounts in each bill, but wondering how MSEDC has triggered their release and under which authority.
“Respondents do not submit documents or proof of an acceptable office.
If indeed cut the power supply, then on the basis of what the electricity bill is paid indicating consumption of 114 units in that period.
Notifications incurred by MSEDCL are wrong and illegal and do not apply to complainants.
Therefore, even snapping the power supply is illegal.
“According to them, law enforcement agencies need to be considered specifically while providing services to customers and if they themselves violate and abuse their rights, harassment needs to be taken seriously and punished.
“If the senior MSEDCL officer has intervened in time, it will be possible to easily resolve complaints.
It seems that the officers concerned do not have adequate supervision and control of employees.
Respondents must bear financial losses due to defects in their services and, therefore, therefore The financial burden will fall indirectly to other consumers in the state, “said the judges.
