Vadodara: Home Grown Dairy Giant Amul is busy fighting against legal battles against metros in Mumbai & Delhi.
The High Court in Mumbai and Delhi has issued a temporary commandment in at least half a dozen cases after the largest food marketing organization in India filed a trademark and copyright violations of the player.
About four brands sell milk and dairy products with artwork, design, motifs, color schemes, and fonts on bags, packages similar to Amul have appeared in the Mumbai market, Delhi-NCR and Uttar Pradesh.
This milk bag even copied the iconic mascot – Amul Girl – known as the Polka Dotte skirt and half bound horse.
In most cases, milk bags are sold by adding / replacing only one or two letters in the Amul brand name.
In fact, the owner of a Plaghar-based company has filed a business at the Bombay High Court which states that he sells ‘Amsul Tuaza’ which is similar to ‘Amul Taaza’ – registered trademarks owned by the Kaasa Limited Regency Management Union (KDCMPLUL) known as Amul Dairy.
Kdcmpul is a member of the Gujarat Cooperative Milk Marketing Federation member (GCMMF) – Apex organization of all Gujarat milk cooperatives.
This has enabled GCMF to market dairy products exclusively with the Amul trademark.
While applying for a business that he had stopped the production and sale of products under the Impug sign – Amsul Taaza – starting September 2021, the owner even paid Rs 75,000 as a damage to GCMMF.
The Bombay High Court observed that the defendant only added a ‘s’ letter to Mark Amul who was famous for making an impuned mark – Asmul Taaza.
“There is no stretch of imagination, the use of impuogned signs and artistic works can be said to be accidental or co-incidental.
There is no other conclusion than driving good intentions and the reputation of the Plaintiff and drawing unfair benefits can be withdrawn,” NJ Jamadar Justice Court observed while providing assistance Injime.
The Delhi High Court recently passed Ad Interim Ex Parte Adjunction against Vegetables and Food Shree Baniy Bihari based in Delhi, which has begun to produce and sell ‘fresh cream’ on the Delhi / Up market with the same packaging design from Amul Fresh Cream.
The company has been detained from using trade dresses and trademarks from Amul Fresh Cream.
The court then appointed a local commissioner to check the place, prepared inventory and examined the party account book.

Amul also filed a lawsuit in the Delhi High Court against companies that sell kitchen equipment and equipment such as Amul Pressure Cookers and other companies that produce, sell, and deal with paint brushes, rollers, putty knives and other products ‘and’ KBI signs.
