Islamabad: Kulbhushan Jadhav, National India Detained in Pakistan, has been given more time by the Islamic High Court of Islamabad to appoint a legal counsel to submit a petition on his behalf of his belief and the death penalty was ordered by the Pakistani Military Court in 2017.
The three of them were Islamic HC Benchabad at Under Judge Athar Minallah heard the case on Tuesday.
This case was filed by the Ministry of Law to appoint a lawyer for Jadhav.
Other judges on the bench include Judge Aamer Farooq and Justice Miangul Hasan Aurangzeb.
Pakistani Attorney General Khalid Jawed Khan and Amicus Curiae Advocate Hamid Khan also appeared before the court in this case.
The Attorney General was placed in the presence of court correspondence between Pakistan and India to give advice to Jadhav to adhere to the International Court Decision (ICJ).
Khalid Jawed Khan told the court that only that could appoint a lawyer for Jadhav since India did not respond to the previous court order of the appointment of legal counsel for him.
Ag told the court that India wants consular access to Jadhav in a separate room, but the authorities, according to him, cannot risk leaving alleged Indian spies with Indian representatives because of the possibility that they can endanger them.
“They can endanger them just by shaking hands with him,” he said.
Justice Athar Minallah replied that the court “wanted to fully implement the ICJ decision and this was only possible by effective processing”.
“We need to continue in accordance with the Vienna Convention because his life depends on the results,” he said, adding that the court believed that India would not waste this opportunity and advance.
Before delaying this case until next month, the court asked the Attorney General to find responses from the Indian government again.
In April this year, the legal representative of the Indian High Commission Shahnawaz Nonsumen has forgiven himself from appearing in this case.
On October 6, 2020, Veteran Lawyer Makhdoom Ali Khan and Abid Hassan Minto had refused to appear in court for their own reasons.
Jadhav, according to Pakistan, was arrested on March 3, 2016 from the Mashkhel Balochistan area.
However, New Delhi claimed that he was a retired Indian Navy officer and was kidnapped from Iran.
A secret Pakistani military court has sentenced to death in April 2017.
His appeal against his belief was rejected by the military appeal court.
In India’s appeal, ICJ has stopped Pakistan from conducting a death sentence.
