Days Following Alapan saga, CVC Creates vigilance clearance Should for Using retired govt officials

KOLKATA: The Central Vigilance Commission (CVC) has led that the secretaries of all of the Central government ministries and divisions, principal executives and chief vigilance officials of public sector undertakings to find vigilance clearance prior to using a retired officer on humanitarian or consultancy basis.
Interestingly , the correspondence came just a couple of days following the West Bengal government participated former principal secretary Alapan Bandyopadhyay because the primary advisor to chief minister Mamata Banerjee.

The CVC in its own letter said the lack of a uniform process occasionally resulted in a scenario where officials with corrupt previous or cases pending against them got participated.
“The Central Vigilance Commission has discovered that the lack of a uniform defined process for getting vigilance clearance, even before participating retired officers from government businesses, occasionally result in a scenario where officials having corrupt ago or with cases pending against them are participated from the authorities organisations.
Such a scenario not only contributes to unnecessary complaints/allegations, but can be contrary to the tenets of equity and probity, that’s the fundamental principle governing the operation of government businesses,” the letter stated.
“In regard to officers belonging to All India Services, Group A officers of Central authorities or their equivalent at different businesses owned or regulated by the Central authorities, prior to offering them employment on contractual/consultancy foundation, vigilance clearance in the company organisation, where the authorities officer had retired, and must be automatically accessed,” it stated.
“If a retired officer had functioned more than 1 organisation, then vigilance clearance ought to be obtained from most of the organisations in which the retired officer had functioned during a span of 10 decades before his retirement,” the letter added.
The CVC also has made it very clear that the private sector must follow the process before applying retired officials.
“It’s been observed on some events, immediately following their retirement from government businesses, retired officers have been taking up full time job/contractual missions privately organisations.
Fairly often, cooling period, as prescribed under the principles of businesses concerned, isn’t detected prior to taking up such supplies.
Post-retirement approval of supplies with retired government officials without even detecting cooling off period represents serious misconduct on their character,” the letter stated.
“All government organisations can, therefore, devise suitable rules/guidelines for the employees to make certain that post fertility, cooling period is seen by these before accepting any deal from private business.
The rules/guidelines should comprise process of seeking/obtaining before accepting supply from private industry entities throughout cooling period.
The pertinent service/conduct rules must likewise be revised/modified to make sure that, if necessary, proper action may also be initiated in the event of breach of such principles by retired workers,” it added.
