Delhi HC rejected defense underage students who were looking for permission to sit in NEET-2021

New Delhi: The Delhi High Court on Tuesday rejected search direction to the National Test Agency (NTA) to allow applicants / students aged 13 months under the age of the NEET-2021 entrance conducted by the test body.
Judge Judge DN Patel and Justice Jyoti Singh on Tuesday while rejecting the request, said we saw no reason to entertain this problem, no substance.
We did not find reasons to reduce age criteria.
The court also applies the cost of 10,000 Rs to the Applicant.
The Petitioner’s students also urged the court to direct NTA to change the impuanned regulations relating to the minimum age criteria of 17 years in December 2021 for the first year’s UG medical course for students who appeared in the entrance test (NEET-2021) by replacing with 15 years similar to jee- 2021 for UG engineering courses, because this is Ultra Vires for the 1956 Indian Medical Council Act.

The petition was submitted by a small student through Advocate Surendra Kumar Yadav.
The Indian Medical Council issued a notification of impuits at graduates of medical education 1997 related to eligible age to appear in the entrance test for the MBBS program.
In notifications / regulations, the feasibility criteria for entering medical courses related to age mentioned in Points No.
4.1 “He will finish the age of 17 on or before December 31, the year of receipt to MBBS”.
“The age requirements of 17 years on or before December 31, the year of entry into MBBS were not mentioned in the Indian Medical Council Act, 1956,” reading.
“The applicant is a small citizen in India.
The date of birth of the applicant according to the document is January 26, 2006 that the applicant is a smart student and passed the jatikulation in 2019 and the 12th grade exam in 2021,” he added.
The applicant said that he suffered a lot of mental and psychological day after day because he could not finish registration on the website, the Petitioner’s lawyer argued.
A classmate from the applicant appeared for NEET-2021 but due to a 13-month problem, the applicant could not even fill out the online form for the entrance test, the Petitioner said.
“It will also be a violation of fundamental rights mentioned in Articles 14, 16, 19 and 21 India’s constitution directly or indirectly for the Petitioners who are students and want to read UG courses in medicine,” said the petition.
