New Delhi: The Delhi High Court on Tuesday rejected the petition which was looking for directions to the city government not to disrupt Hookah herbal sales and services in the restaurant.
Justice V Kameswar Rao noted that all restaurants and pubs have been closed based on orders authorized by Delhi Disaster Management Authority on January 11 because of the surge in positive Covid-19 cases.
The judge said that there was no direction that could be forwarded to the petition by the restaurant owner.
Delhi’s government advice Santosh Kumar Tripathi said that the government authorities reviewed the situation of the pandemic in consultation with larger experts and public interests.
He stated that when an order was ratified by the court in November last year to allow the sale of herbal stretches in the restaurant, there was no wave of Covid-19 cases and the prohibition was due to the command authorized by the Delhi Health Department and not DDMA.
“Given the orders on January 11, 2022, there is no direction that can be given as sought in the writing petition.
The order on November 16 can be distinguished.
There are no benefits in the petition and ordered by the court.
Attorney Anubhav Singh, appears for the applicant, looking for directions from The court to stop the authorities from disrupting Hookah’s herbal sales and services from the establishment of the Petitioner.
He handed over the court has given an order on November 16 last year to allow sales and services subject to compliance with the appropriate Covid-19 behavior.
The Petitioner argues that the Herbal Prohibition Hookah violates guaranteed rights in Article 14, 19 (1) (g), and Article 21 of the Constitution.
