Delhi HC Reunits Marriage Couple Inter-Caste

New Delhi: Delhi High Court reunite inter-caste married couples while directing the Delhi police to ensure the security of the Applicant’s wife.

Meena, wife of the Applicant, at Nirmal Chhaya Home, Jail Road Hari Nagar under the care and custody of Janak Puri Police Station Inspector Sharma.
The bench made it clear, in the order dated January 20, that the Superintendent of Nisha Sharma will be held personally responsible for escorting Ms.
Meena to Nirmal Chhaya and lodging there.
The high court said Nirmal Chhaya home inspectors are directed to not allow anyone, other than Nisha Sharma Inspector or an applicant to meet Meena without permission in this court.
The bench directed the Applicant to arrange air tickets for his wife to travel from Delhi to Chennai.
The court also directed the inspector Nisha Sharma to ensure the safe passage of Meena from Nirmal Chhaya home to the Indira Gandhi International Airport, Delhi and ensure that it rises to Chennai.
The Court directed counsel appearing on behalf of the applicant to coordinate the programs mentioned above.
The bench further said that, in accordance with the wishes expressed by him in front of us, “Meena are at Liberty to join the Applicant company.” The court directed to a copy of the order must be sent via email to the Inspector Nisha Sharma and through him, to the home supervisor Nirmal Chhaya for compliance.
This direction is passed by the High Court after hearing the Habeas Corpus petition moved by the husband, who is a native of Rajasthan and is currently living in Chennai.

Rajarajan pray for directives to produce and liberate the Applicant’s wife, who allegedly illegally confined by her father.

During the hearing the petition, Meena appeared before the bench through a video conference from his father’s house and expressed a desire to file a submission before the safety of the police station.
After this, the court directed police to take him to Delhi Janakpuri Police Station where he clearly expressed his desire to join the company of her husband.
The court said it is important to note that Meena made a statement before the judge under serious duress.
He was threatened by her family that the Khap Panchayats in Rajasthan are looking at the validity of the marriage and has decided to eliminate it and her husband.

Advocates Raghunatha Sethupathy Counsel for the Applicant submitted that although the Petitioner is a resident of the District Dholpur, Rajasthan, he is currently employed in Chennai.
He submitted that the applicant would be in a position to set his wife to travel to Chennai.
The petition said the marriage diselolah in Arya Samaj Vivah Mandir Trust in Gokhle Bandhan Market of Tees Hazari in New Delhi on November 22, 2021.
The marriage was registered at the Delhi government on 24 November 2021.
The married couple moved to Chennai on November 28 to their matrimonial home , When they want to settle in Rajasthan, they moved to Jaipur on December 12, 2021.
The petition further states that on December 16, Father and relatives Meena along with police officers from Sardar Police Station, Jaipur illegally retrieve the Applicant and his wife to the police station where they given a life threat.
“On the same day, the Applicant’s wife was taken forcibly by his father and about Rs 20 thousand along with the phone taken from the applicant.
After that, he was locked up illegally in prison for one day and was finally released December 17th 2021.” The petition further said that the Applicant had visited her home in Jaipur but was surprised to see that the house is locked by the police and she was not allowed to enter.
Then he returned to Chennai.
After reaching there, he discovers that his wife’s father to transfer Rs 95,000 from various bank accounts using phone-PE from her cell phone.
Applicant says she filed a complaint through Speed ​​Post to the Deputy Commissioner of Police, Shahdara and Sho, Farsh Bazar police station in New Delhi.
However, no action was taken by police officers.
