New Delhi: Delhi Cabinet on Friday refused to approve the Delhi police list from a special prosecutor to appear in court cases related to violence during the January 26 farmer protest.
It observed that the process would not be fair and impartial if police lawyer Delhi, who was investigating these cases, appointed.
The cabinet decided that the prosecutor panel appointed by the Government AP would do the job.
Lieutenant Governor, Anil Baijal, has suggested the AAP government to approve the Delhi police panel.
It has set a stage for escalation in confrontation between state and LG governments.
In a separate decision, the Cabinet also refused to give a nod to the three lawyers recommended by Delhi police for the Northeast Delhi riot case.
The government said in a statement that the center pressed the cabinet through LG to approve the Delhi police panel.
“It is the duty of every Indian to support the country farmers.
We have not made assistance and only fulfills our duties of farmers.
Farmers are not criminals or terrorists, they are our food providers,” Chairman of the Minister of Kejriawal Tweeted in Hindi after the cabinet made a decision.
The decision was delivered to LG which might refer to the problem to the President.
If LG takes the course, it will be the first example of the GNCTD Law (Amandment), 2021 authorized by Parliament which gives more strength to LG.
Following a similar struggle, the six panel of lawyers suggested by Delhi police for the case of Northeast Delhi riots was told last year after LG referred to the problem to the president.
Providing a digital address, Deputy Chief Minister Manish Sisodia said LG did not have the right to decide what the government was selected in this matter.
“This LG habit is to train Veto on all the Government AAP has opposed democracy, against the constitution and with the Constitutional SC bench decision.
It will destroy democracy,” he said.
