Ahmedabad: A woman has approached the Gujarat High Court challenging divorce decrees obtained with mutual agreement and claiming that she was made to sign a divorce letter while she was very drunk under drugs to treat their severe depression.
The woman lived in Ahmedabad and her husband lived in Muscat, Oman, with their nine-year-old daughter.
After the complaint of the woman even though there was an agreement about the rights of the visit, she was not allowed to talk to her daughter, HC ordered the man to allow him to do it.
In this case, the couple married in 2010 and lived in Muscat.
The woman claimed that she had severe depression and her husband took her to India in November 2015 for care.
He knew that the ticket was purchased by TPP.
He alleged that he was made to sign Affidavit and divorce temporary requests under the influence of drugs.
He doesn’t know this.
On the day of departure, the husband went to Muscat with his daughter.
In 2016, divine divorce was taken.
Three years later, the woman challenged the decree that accused fraud.
Her husband denied this claim.
The court questioned the truth of the claim because the parties were required to sign a written statement that was seeking divorce through mutual agreement before the court.
The court also said that civil suit must be submitted in this case and appeal cannot be maintained.
The court added that the woman should be suggested correctly when she sought help from the HC authority.
HC posted further hearing after vacation Diwali.
